
SIU Launches Search and Seizure Operation at JB Marks M

Maladministration Investigation
Potchefstroom – The Special Investigating Unit (SIU) executed a high-stakes search and seizure operation at the JB Marks Local Municipality on Thursday morning, 07 November 2024, following a court order granted just the day before.
The operation, which unfolded at 9:30 am, was backed by the Hawks and the South African Police Service (SAPS) as the SIU sought critical evidence for an ongoing investigation into serious allegations of maladministration.

The investigation, centered on the municipality’s controversial procurement practices, particularly the construction of a flood line canal adjacent to the N12 provincial road and Ikageng Extension 11, was set in motion after Proclamation 196 of 2024 empowered the SIU to probe claims of mismanagement and corruption.
The SIU’s actions are part of a broader effort to audit and ensure compliance in the awarding of tenders for goods, works, and services from January 2015 to October 2024.
Despite the urgency of the matter, the SIU had faced significant obstacles in their attempts to engage the municipality. Since the proclamation’s release on 04 October 2024, the SIU reached out multiple times, seeking voluntary cooperation and access to documents. However, their efforts were met with silence, prompting the unit to seek legal recourse. On Wednesday, 06 November, the Potchefstroom Magistrate Court granted the SIU a warrant to search the premises and seize any evidence that could shed light on potential corruption and financial mismanagement.
The search was a meticulous operation, with officials combing through municipal offices for critical documents and electronic data. Among the materials seized were company registration documents, payment records, invoices, purchase orders, and remittance advices.
In addition, electronic devices—including laptops, mobile phones, and external storage media—belonging to key municipal officials were confiscated, along with any relevant data such as emails and cloud storage linked to the tendering process.
The SIU’s move signals a significant escalation in its efforts to root out corruption and ensure transparency at local government levels. Under the Special Investigating Units and Special Tribunals Act of 1996, the SIU is empowered to subpoena bank statements and cell phone records, search for evidence, and question witnesses under oath. If the investigation uncovers criminal activity, the SIU has the authority to refer the matter to the National Prosecuting Authority (NPA) for prosecution.
“The SIU is committed to upholding the rule of law and ensuring accountability within public institutions,” said SIU spokesperson, Kaizer Kganyago. “This operation is not just about gathering evidence—it’s about protecting the public interest and addressing allegations of corruption that threaten the integrity of local governance.”
The JB Marks Local Municipality, formerly known as Tlokwe Local Municipality, has been embroiled in allegations of procurement irregularities for some time. The outcome of this investigation could have far-reaching implications for both the municipality and the individuals involved in the tendering process. If evidence of criminal wrongdoing is found, it could lead to serious charges, including fraud, corruption, and maladministration.
As the SIU continues its probe, the public and government officials alike will be watching closely to see how the case unfolds and whether those responsible for the alleged misdeeds will be held accountable.
