PALAGANGWE-NGENGO IN COURT FOR FRAUD
MAHIKENG – The former Mayor of Lekwa-Teemane Local Municipality, Kagiso Palagangwe, his wife, Meriam Fetsang Mokoka, as well as the former Municipal Manager, Ndoda Mgengo, are facing charges relating to fraud allegedly committed in 2015. According to court reports, it is alleged that during the period of 15 January 2015 to 11 February 2015, Palagangwe and Mgengo, who were serving in the office of the Municipality, concluded a sale agreement for a property in Pretorius Street in Christiana with Palagangwe’s wife, Meriam Fetsang Mokoka. MORONGWA has seen court papers in which Palagangwe, and Mgengo, alleged that the Council took a resolution to sell the property in question. A payment of R21,888.00 was made on October 15, 2015, subsequent to the sale of the agreement. Section 112(1) of Municipal Finance Management Act 56 of 2003 makes provision for a Supply Chain Management policy in which a municipal entity must be fair, equitable, transparent, competitive, and cost-effective and comply with the prescribed regulatory framework for municipal supply chain management. Section 117 of the Municipal Finance Management Act 56 of 2003 provides that no Councillor of any municipality may be a member of a municipal bid committee or any other committee evaluating or approving tenders, quotations, contracts, or other bids, or attend any such meeting as an observer. In reference to these Municipal Acts, the state concluded that Palagangwe, Mgengo, and Mokoka were guilty of fraud. The court further states that the three accused acted with a common purpose to unlawfully defraud the municipality by pretending that the Lekwa-Teemane Municipality Council had made a resolution to sell the property.
They briefly appeared in Court and the case was postponed to 03 February 2023
